Assumption of Risk; Waiver of Liability; and  Release of Claims


Participants named within this online registration desire to participate in activities associated with the Student Showcase at the National Academy of Inventors Annual Conference, including those that take place at the Annual Conference (the “Activities”). The National Academy of Inventors (“NAI”) does not select, employ, or otherwise exercise authority or control over the chaperones, mentors, judges, and other participants in the Activities. Participants (or their Parent/Legal Guardian), and not NAI, are responsible for Participant’s safety. Participants acknowledge that participation in the Activities may pose risk of bodily harm and property damage, such as from boarding vehicles, crossing streets, climbing stairs, using tools, lifting items, and other physical actions. Participants (on their own behalf) and Parent/Legal Guardian (on their own behalf and on behalf of their child/ward), to the fullest extent of the law (a) assume the risk inherent in the Activities, (b) waive liability and covenant not to sue NAI for any injury he/she/they may have arising from the Activities; and (c) release NAI from any and all claims he/she/they may have against NAI arising from the Activities. The foregoing applies to any claims now known or later acquired at law and in equity, in all jurisdictions throughout the world, and to the National Academy of Inventors, its officers, directors, employees, volunteers, agents, affiliates, successors, and assigns. Participants/their parents/legal guardians acknowledge the potential risk of harm in connection with the activities. They are voluntarily participating in the activities and assume the risks of injury, including death, and of property damage, including those caused by the negligence of the National Academy of Inventors.



This Agreement is the sole and entire agreement of Participants and their Parents/Legal Guardians and NAI with respect to the stated subject matter and supersedes all prior and contemporaneous understandings, agreements, written and oral. If any term or provision of this Agreement is unenforceable in any jurisdiction, it shall be revised so as to ensure its enforceability in a manner consistent with the intent of such provision, and the remaining terms shall not be affected. This Agreement is binding on and shall inure to the benefit of the Participants, their heirs, legal representatives, and personal representative, and NAI, its successors, and assigns. This Agreement shall be governed by the laws of Florida. Any litigation shall be brought exclusively in the Circuit Court for the County of Hillsborough, Florida, or the United States District Court for the Middle District of Florida. Participants and their Parents/Legal Guardians hereby consent to the exclusive jurisdiction of such courts and waive the application of forum non conveniens. If this Agreement is signed by Participant, Participant represents that they are at least 18 years old; if Participant is not at least 18 years old, this Agreement must be signed/accepted by Participant’s Parent/Legal Guardian who has authority to enter into this Agreement.
