Way Release & Waiver Agreement
Way is a program that gives supporters the chance to turn their passions
and interests into unique fundraisers to benefit the ABTA. The funds raised
allow the ABTA to provide vital brain tumor resources to patients and their
families, fund promising research studies, and conduct nationwide brain tumor
educational programs. To ensure your event meets industry standards and
follows ABTA policies, please read below and carefully adhere to the guidelines
while planning your event.
As event organizer, you agree to:
full responsibility for the organization, promotion, liability and execution of
the event, and obtain necessary insurance.
activities in accordance with ABTA policies, written materials and guidance
received by ABTA staff.
all activities are in full compliance with applicable federal, state and local
laws, regulations and legal standards.
best efforts to ensure the event is of the highest quality with respect to
venue, activities, and logistical preparation, providing a safe and enjoyable
experience for all participants.
solely liable for all costs associated with event including, but not limited
to, venues, insurance, entertainment and food and beverage and not sign any
contracts on behalf of ABTA. Please note:
You are responsible for filing all necessary event permits, applications and
providing insurance, as required, for your event.
any use of the ABTA name and/or logo to staff for approval prior to it being
used. This includes paid advertising. Please
note: You are solely responsible for the cost of paid advertising.
you, as event organizer, are hosting the event and include “to benefit the
American Brain Tumor Association” on all materials. Please note: You must include the percentage of proceeds to benefit the
ABTA on all materials.
ABTA staff in advance of any corporations or businesses you are approaching for
sponsorship or in-kind donations to avoid overlap with existing partnerships.

checks from event proceeds are made out to the ABTA and mailed to the office within
14 business days of event.

The American Brain Tumor Association agrees
on event planning, logistics and fundraising tips from a dedicated ABTA staff
fundraising page and access to participant center with sample letters and other
ABTA logo upon request and approval.
of acknowledgment to confirm funds from event to benefit the ABTA.
or emailed confirmation for donations over $25 made directly to the ABTA.
listing on www.abta.org upon
The American Brain Tumor Association will
attendance, ticket sales, sponsorship or in-kind donations.
an ABTA representative at your event.
reimbursement for any event-related expenses.

mailing lists of vendors or donors.
a tax receipt for in-kind donations that do not directly benefit the ABTA

reserves the right to withdraw its approval and participation in a Breakthrough
Your Way event if the above guidelines are not strictly adhered to.
Having read this Release
and Waiver Agreement and knowing these facts and in consideration of hosting a
fundraising event, I hereby release, waive, discharge and covenant not to sue
for myself, heirs, executors and administrators and waive any and all claims I
may have for any loss, liability, damages, or costs against American Brain
Tumor Association (ABTA), its officers, directors, employees and agents, and
all sponsors and individuals associated with the event, their representatives, successors
and assigns (the “Released Parties”) for any and all injuries or illnesses
suffered by me in connection with this event, including pre- and post-event
activities. I agree to indemnify and save and hold harmless the Released
Parties and each of the above mentioned entities/individuals.
understand that ABTA may use video, digital pictures, movies, photographs,
and/or audio recordings of your participation in this event. You hereby
irrevocably grant to ABTA and to its successors, affiliates, employees, agents,
and assigns (collectively, “ABTA”), the absolute and unrestricted right to use,
copy or reproduce your name, voice, picture, likeness, stories and profile,
whether in original or modified form, in promotional and advertising materials,
publications, news releases, Web sites or other forms hereafter conceived
produced for or by ABTA and used by ABTA, including future publications and
web-pages. You understand circulation of
the above can be worldwide and there will be no compensation to you for this.
You further understand that
publication may be accomplished by several means, including, without
limitation, electronically via the Internet and that after publication ABTA
will be unable to prevent other persons from gaining access to and copying my
picture, likeness, stories, and profile and subsequently using, altering, or
republishing it/them without your consent.
You hereby waive all rights and release and discharge
ABTA from any and all claims, demands, or causes of action that you may have or
may hereafter have for defamation, libel, invasion of privacy, publicity, or
personality, misappropriation, infringement of copyright or trademark or any
other intellectual property, or any other matter, based upon or relating to the
use and exploitation of your participation in this event.
You understand and voluntarily accept the possibility
of unconsented-to third party use, alteration or republication; and waive any
claim for damages against ABTA arising from such actions by these third
